Holmes Beach police arrested Bradenton resident William Boswink, 44, Nov. 4 on two third-degree felony charges for alleged battery on a law enforcement officer and resisting police with violence.
He also was charged with a first-degree misdemeanor for a second offense of driving with a suspended license.
An HBPD officer stopped a motorist on Manatee Avenue in a vehicle that had been pinged by the city’s license plate recognition system because the registered owner, Boswink, had a suspended driver’s license.
After speaking with Boswink and two passengers, an adult in the front passenger seat and a juvenile in the back, the officer determined Boswink was charged in September with knowingly driving with a suspended license.
The officer had Boswink exit the vehicle and informed him he was under arrest but then allowed him to get his phone from the vehicle so he could call someone to get the juvenile, who was related to him.
However, Boswink became agitated inside the vehicle. The officer reported that he “went to grab his right arm to pull him towards me and place him into custody.”
The report states that Boswink resisted and “got in an aggressive posture and angrily swung his arm and elbow towards me and tried to swat me away.”
When the officer continued trying “to gain control … by going hands-on,” Boswink “forcefully pushed my hands and arms away from him.”
The officer stepped back, drew his Taser and ordered Boswink to get on the ground. He complied and, when backup arrived, he was arrested and transported to the Manatee County jail.
Boswink remained in custody under $15,500 bond as of Nov. 13.
The juvenile was turned over to his mother and the adult passenger was released from the scene.
If convicted, punishment for a third-degree felony charge includes up to five years in prison, five years of probation and a fine of up to $5,000.
Punishment for a first-degree misdemeanor charge includes up to one year in jail, one year of probation and a fine of up to $1,000.
An arraignment will be Nov. 19 at the Manatee County Judicial Center in Bradenton.
