After pleading guilty to a class-C felony offense, a 79-year-old Anna Maria resident was sentenced to three years of probation for illegally dispensing oxycodone from a Bradenton clinic.
Senior U.S. District Judge James S. Moody Jr. also sentenced John Allen Lanning of Sycamore Avenue to three months of home detention, which he began serving Sept. 30.
Lanning, who faced a 20-year maximum imprisonment, will begin serving his three years probation Jan. 1, 2015.
According to a Florida Department of Public Health website, Lanning holds a retired license that expired Jan. 31.
A 29-count federal indictment filed in January 2013 charged Lanning and four others with a conspiracy to illegally dispense narcotics contrary to proper medical practices, such as not verifying patient identities or the need for such drugs.
As it relates to Lanning, the indictment was dismissed in accordance with the plea agreement.
The doctor worked as a physician at the Medical Clinic located at 1910 Manatee Ave. W. from March to May 2010, during which Lanning saw 20-30 patients a day, according to a press release from the U.S. Attorney’s Office.
In an undercover sting, Lanning prescribed oxycodone to a federal Drug Enforcement Administration agent who did not need it.
Lanning’s probation prohibits him from possessing a controlled substance or committing a crime.
The home detention requires he remain at his residence except for employment or other activities approved in advance by his probation officer.
As part of his sentence, Lanning was fined $100, and the reasonable costs of his probation.
According to William C. Daniels, the U.S. Attorney’s Office public affairs specialist, several of Lanning’s co-defendants have not been sentenced.
