A 28-year-old homeless man found incompetent to stand trial has been committed to the Florida Department of Children and Family Services — temporarily suspending two cases in 12th Judicial Circuit Court.
Kyle Mills, 27, formerly of Indiana, was released July 9 to a DCFS affiliate from the Manatee County jail.
Twelfth Circuit Judge Deno Economou found Mills incompetent June 18 after receiving mental health expert reports. The judge suspended a Holmes Beach case on resisting arrest and trespass, as well as a separate case of battery to a law enforcement officer while in jail.
Mills was first arrested in March by the Holmes Beach Police Department after being trespassed at Walgreens, 3200 E. Bay Drive.
While being transported by HBPD to the Manatee County Sheriff’s Office custody, Mills told the Holmes Beach police they were at war and allegedly kicked, grabbed and tried to bite the officers.
In addition to the resisting arrest and trespass, HBPD initially arrested him for battery to a law enforcement officer but that charge was not formally filed by the state.
A month later, while in jail, Mills charged a cell door, struck a guard in the face and wrestled with the officer until Mills could be restrained by other deputies, according to a Manatee County probable cause affidavit.
