A Bradenton man facing a second-degree misdemeanor for driving under the influence pleaded to a lesser charge of alcohol-related reckless driving.
Peter Maggio, 53, was arrested in March 2015 on the DUI charge by Holmes Beach Police Department and ticketed for open container, expired tag and registration, altered tag and no proof of insurance.
According to the HBPD arrest report, Maggio had 18 beer cans in his truck and offered two breath samples, measuring .082 and .077. The legal limit is .08.
The assistant state attorney amended the DUI charge to “wet reckless” and Maggio pleaded no contest.
Twelfth Judicial Circuit Judge Mark Singer accepted the plea, ordered 12 months probation and dismissed the other traffic citations.
The probation order filed Dec. 23 requires Maggio to complete a DUI program, attend a victim-impact panel, receive a substance abuse evaluation and treatment if deemed necessary and pay $821 in fines or costs.
