The state attorney office dropped a third-degree felony charge Nov. 17, 2022, for possession of a controlled substance against Holmes Beach resident Michael Jordan, 47.
Holmes Beach police arrested Jordan in September 2022 on a second-degree misdemeanor charge for allegedly driving under the influence of alcohol.
Jordan also faced a charge of a third-degree felony for alleged possession of a controlled substance after police found pills in his pocket.
The pills field-tested positive for LSD or “acid” but were later lab-tested to be CBD, or cannabidiol, an active ingredient in cannabis. Thus, the third-degree felony charge was reduced to a first-degree misdemeanor for possession of less than 20 grams of marijuana.
Jordan pled nolo contendere or no contes to both misdemeanor counts and participated in the Driver Enhanced Treatment Education Rehabilitation program.
Judge Heather Doyle of the 12th Judicial Circuit Court ruled in April to withhold adjudication — when a judge orders sanctions but does not issue a formal conviction — against Jordan for both charges.
Doyle sentenced Jordan to complete one year of probation and 50 hours of public service, as well as pass in-person DUI school and participate in a Mothers Against Drunk Driving live victim-impact panel within six months of the ruling.
She also fined Jordan $250 but ruled that additional public service work could be completed instead.
Doyle filed an early termination of probation Oct. 19 with the approval of the SAO and Jordan’s probation supervisor.
