The tree house owners will seek a reprieve from the fines imposed by the city of Holmes Beach.
At 9 a.m. Friday, July 1, a Holmes Beach magistrate will hear a request from the owners to postpone $15,350 in fines — accruing at $50 per day — for the duration of their appeal.
The owners’ attorney, David Levin of Icard Merrill in Sarasota, filed a notice of appeal May 25 in the 12th Circuit Court.
Magistrate Kelly M. Fernandez of the Lakewood Ranch law firm Persson & Cohen ordered the fines May 23 against Lynn Tran and Richard Hazen, who built the beachfront structure without state or city permits in 2011 on their property at 103 29th St.
Fernandez heard the case and imposed the fines after two courts upheld a 2013 Holmes Beach Code Enforcement Board decision, which ordered $4,271 in costs and code compliance or the tree house’s removal.
The July 1 hearing will be held at Holmes Beach City Hall, 5801 Marina Drive.
